A United States Court of Appeals has authorized the federal government to deploy military personnel to Portland, Oregon. This decision, issued on Mon, Sep 27, 2025, by the Ninth Circuit Court of Appeals, permits the deployment of 200 National Guard members to the city.

The court noted, "After considering the record at this preliminary stage, we conclude that it is likely that the President lawfully exercised his statutory authority" regarding the deployment of the state's National Guard.

The federal government has undertaken similar actions in other cities and conducted immigration enforcement operations involving federal agents. These operations have faced criticism for alleged racial profiling and civil liberties violations.

The American Civil Liberties Union (ACLU) criticized the court's decision, asserting that the domestic deployment of troops should be reserved for rare, extreme emergencies. Hina Shamsi, Director of the ACLU’s National Security Project, stated, "The presence of troops in American cities erodes a sense of safety and undermines core freedoms." The ACLU highlighted concerns over the use of excessive force against demonstrators.

The administration has described Portland as "war-ravaged" by protesters who allegedly obstruct immigration enforcement, despite the absence of declared emergency conditions in the city.

Circuit Judge Susan Graber, in a dissenting opinion, criticized the ruling, stating it undermines constitutional principles and the rights of states and individuals.
